OVERVIEW
The terms “I”, “we,” “us,” and “our” “Service Provider” refer to michelle cachucho a living woman. The term the “Site” refers to riseupin.love. The terms “client”, “user,” “you,” “your”, “he” and “she” refer to site visitors, customers, members, living men and living women and any other users of the site.
By using this website or participating in any live events or online programmes, users are consenting to the below terms and conditions.
www.RiseUpIn.Love is a Private Members Club
By using this Site or joining any membership or programme offered on www.riseupin.love, users are joining a private club with its own rules of participation; michelle cachucho, a woman, is not a company, or legal entity, but is a private club together with those men and women who wish to join her in this club;
For the efforts required in the running of online programmes or in person events, compensation, which changes depending on the programme or event, is made by the men and women who join the club to the Service Provider.
Users who join the club agree he / she is of sound mind, rational and fully cognisant of his/her immediate reality and his/her place in it, with full mental capacity to enter into this agreement and membership of this club. Users of the club agree to apply the suggestions, tools and techniques sensibly, and agree to investigate for themselves or with help from medical practitioners on how to apply these at their own risk. At all times he/she accepts full personal responsibility for any results or outcomes, whether actual or perceived, that may result from experiencing thoughts or feelings or taking decisions or actions based upon the provision of any service provided under this agreement.
At all times he/she accepts full and absolute personal responsibility for any disclosed or discussed consequences upon the provision of services under this membership or live events and shall indemnify and not hold the Service Provider responsible for any loss or harm, whether actual or perceived, resulting from the services provided.
At all times he/she accepts full and absolute responsibility for any consequences which have not been discussed or disclosed with the Service Provider unless such consequences were reasonably foreseeable or to be expected in the ordinary course of events during or following the provision of the services and failure to disclose or discuss them was a breach of the earlier clause above.
IT IS HEREBY AGREED BETWEEN THE PARTIES THAT:
1. Absolute personal accountability and responsibility shall remain with the User at all times.
2. Any obligation owed by the Service Provider to the User is strictly personal, non-transferable nor assignable to a third party nor to the User´s Attorney(s)/Estate Administrators/Executors or other Assignees.
3. Nothing herein may be waived or amended except in writing and signed by both parties.
4. Nothing herein agreed is intended to limit any common law duty of care owed by Service Provider to User under the accepted principles of tort law for any breach
of Clauses in these Terms and Conditions.
5. By using the Site or any Service provided by the Service Provider, the member indemnifies and holds harmless the Service Provider as well as any supporting teams assisting in programme delivery of all kinds from all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses, as well as third party claims and causes of action, including, without limitation, attorney’s fees, arising out of any breach by the member of any of these Terms and Conditions.
6. In no event shall the Service Providers cumulative liability to the member exceed the total amount of compensation. In the even that no compensation or purchase has been made, the Service Providers liability to the member shall not exceed €0.
The members who join any online programmes or live events offered by the Service Provider may be recorded when participating in any event hosted in part or in full by the Service Provider, which will then be made available to the other users in the club available in the members only area;
At discretion, the Service Provider, reserves the right to terminate the club membership of any user in the club relating to any statements they made or behaviour they exhibited that is deemed offensive or inappropriate;
The Service Provider can speak to the members of the club as a woman and a man only; Everything shared in online programmes or live events has been created, researched with the intention to be shared verbally, visually and energetically by the Service Provider, within the club and outside of the club is claimed by the Service Provider as the the Service Provider´s property;
The Service Provider, reserves the right to change the rules of the club at any time. It is the responsibility of the Members of the club to review these terms and conditions for any changes to these rules. These rules are laws once the members agree to them by signing up for the membership and they also apply to any events in person or online offered by or in collaboration with the Service Provider.
SERVICE
Use of riseupin.love, including access to membership services and live events provided by the Service Provider, is subject to the Terms and Conditions outlined here. These Terms and Conditions apply to all site visitors, customers, members, users and all other users of the site. By using the Site or Service, you agree to these Terms and Conditions, without modification, and acknowledge reading them. The Service Provider and Members agree that the Service is in the nature of education and the Service Provide reserves the right to amend services at any time, without prior notice.
USE OF THE SITE AND SERVICE
Information provided on the Site and in the Service related to online and live events and other information are subject to change. The Service Provider makes no representation or warranty that the information or content provided, regardless of its source (the “Content”), is accurate, complete, reliable, current, or error-free. The Service Provider disclaims all liability for any inaccuracy, error, or incompleteness in the Content.
ACCOUNT CREATION
In order to use the Service, members will be required to provide information such as name, email, password etc. Members agree that information provided is accurate and up to date. Members are forbidden to use any false information to create an account. Membership accounts must not be used for illegal or unauthorised purposes nor shall it violate any laws in the members personal jurisdiction.
LAWFUL PURPOSES
Members may use the Site and Service for lawful purposes only. Members agree to be financially responsible for all purchases made through the Site and Service purchased are solely for legitimate and non-commercial purposes. Members agree to not violate any laws or infringe on the rights of others which could constitute a criminal offence, civil liability or in violation of other laws.
REFUSAL OF SERVICE AND CONFIRMATION
The Services are offered subject to the Service Provider´s acceptance of members order or direct requests through written proposals. The Service Provider reserves the right to refuse service to any person or entity, without the obligation to give reason for doing so. No order or service is deemed accepted by the Service Provider until compensation has been processed or received. The Service Provider reserves the right to remove the accounts held by any individuals representing companies that offer a similar or directly competing Service or any government agents.
All services will be confirmed in email along with membership details. In the unlikely event any errors are found in this email confirmation, it is the responsibility of the Member to inform the Service Provider as soon as possible.
Members will gain access to Services once each order has been confirmed. Users agree and understand that access to Services can be influenced and affected by third party providers to provide the Service (web hosting, website services, email services etc). No breach of contract may be initiated against the Service Provider when reasonable delays in access to the Service occur.
CANCELLATIONS & REFUNDS
Online memberships can be canceled by signing into your account and cancelling your subscription. For live events or programmes please refer to the specific event terms.
No refunds for online memberships will be made for fees already paid and members will continue to have access to the membership area until the end of the month the cancellation was made. Once members have cancelled no further access will be permissible.
For coaching programmes, there is a 30 day cancellation policy. The refund will be calculated by reducing the refund amount by any sessions that have already taken place as well as an administration fee and service fees. Cancellation requests should be provided in writing and submitted to mish @ riseupin.love.
SERVICE PROVIDERS INTELLECTUAL PROPERTY
The Site and Service contain intellectual property owned by the Service Provider, including trademarks, copyrights, proprietary information, and other intellectual property. The Service Providers copyrighted and original materials are provided to members as part of the Service for members individual use only. It is forbidden to license, sell or distribute any materials provide on the Site or in live events without prior or written consent.
This includes but is not limited to sharing material with others, posting on any social media, blogging or podcasting about the material, or in any other way that would in any way appear to distribute the Site or Service’s information with a non-member. The Service Provider reserves the right to immediately remove members from the Service, without refund or completion of payment term, if found to be violating this intellectual property policy.
As part of our Service to deliver our programmes, we may record calls which users consent to. With this consent, you agree to allow us to use the words or video from these recordings for educational purposes, marketing and business development purposes including testimonials without compensation to you or additional permission, publicly on the internet.

USE OF THIRD PARTY TECHNOLOGY AND RESOURCES
The Site and the Service may use services and contain links to third party websites and resources. Users acknowledge and agree that The Service Provider is not responsible or liable for the issues or policies related to the use third party services or resources. Services and links to third party websites or resources do not imply any endorsement by or affiliation with the Service Provider. Use of such third party websites and resources are done with the Users sole responsibility, risk and discretion.
